Pool and Clubhouse By-Laws


Pool Access Token (Fob)
  • The first fob will be free to each owner, with distribution of the first fobs to complete by July 31, 2017.
  • It is the LPEHOA, Inc. homeowner’s responsibility to provide the fob to any resident / renter / lessee occupying their property.
  • Owner fobs will be programmed to access both gates and both restrooms. Owner fobs will not be programmed to access the clubhouse.
  • Unless otherwise approved and issued by the LPEHOA, Inc. Board, only one pool facility access token per LPEHOA, Inc. residence will be issued.
  • Upon sale of the LPEHOA, Inc. residence, it is the old owner’s responsibility to provide the access fob to the new owner.  If the new owner does not receive the access fob from the old owner, a new access fob will need to be purchased at the current replacement cost ($75 as of July 31, 2017).
  • Active LPEHOA, Inc. Board members will be issued a secondary fob that is programmed to access all gates and doors, including the clubhouse. These Board member fobs will be provided to the active board members free of charge and will be turned in when the person is no longer active on the LPEHOA, Inc. Board.
  • The pool maintenance company and the gardener will have an owner fob placed in a lockbox at the pool facility gate. This fob WILL NOT access the clubhouse.
  • Owners who reserve the clubhouse will be provided a clubhouse fob that only opens the clubhouse door, not all gates. This is to ensure that the owner is present to access the pool area.
  • All fobs are uniquely numbered and accordingly “issued” to each owner/board member/pool & gardener/clubhouse user. Pool facility access tokens are issued to each individual homeowner, renter, or lessee and are not to be exchanged with another pool facility access token – this is to ensure proper access controls, enable access monitoring, and will be used to identify residents in the pool facility if issues arise.
  • Based on LPEHOA, Inc. Board approval and purchase, programming, and mailing costs, replacement or additional fobs will be charged at $75 each (cost as of July 31, 2017).
  • Lost or damaged access fobs will be replaced at a cost of $75 (as of July 31, 2017). Additionally, as the keys are uniquely numbered, upon loss, damage, or where owners have sold the property but not provided the key to the new owner – these access fobs will be “turned off” in the access system to prevent entry to the pool area.
  • Replacement access fob costs will be paid to the association management company, in advance of the registered mailing of the replacement access fob. The owner will request the replacement fob from the association management company and pay the replacement cost. Upon verification of acceptable standing (financial and lack of pending Board judgements) and completion of the replacement payment transaction, the association management company will notify the Board that the owner can be issued a replacement fob – at which point, the Board will mail the access fob to the owner via registered mail.
  • Only LPEHOA, Inc. homeowners (or their renter or lessee), in good financial standing (assessments, etc.) will be provided an access token to the pool facility.
  • Any LPEHOA, Inc. homeowners (or their resident, renter, or lessee) with delinquent Association dues, violation of rules or deliberate abuse of the recreation facilities or common areas will not be allowed to access the pool facility. The owner will need to coordinate with the Board to address lack of access to the pool facility

Pool and Spa Rules and Regulations:
  • Only LPEHOA, Inc. homeowners (or their resident, renter, or lessee), in good standing will be allowed access to the pool facility.
  • The pool and spa are for the exclusive use of homeowners / tenants and their guests. All homeowners / residents shall inform their guests of all rules and are responsible for guest adherence to LPEHOA, Inc. rules.
  • Guests should be accompanied at all times by the LPEHOA homeowner, renter, or lessee while within the pool facility.
  • Pool hours are 6 AM to 10 PM daily and subject to change without notice.
  • All access token entry to the pool facility will be recorded, monitored, and documented electronically.
  • The pool facility is under video surveillance – no expectation of privacy is appropriate.
  • The gate is locked when the pool is closed. No one is permitted to use the pool until it is officially open. Entering the pool area when the pool is closed is prohibited and may be considered trespassing. Persons who are in pool area when the pool is closed may have pool access revoked.
  • No animals allowed, except service animals specifically trained to aid a person with a disability.
  • Persons having currently active diarrhea or who have had active diarrhea within the past 14 days shall not be allowed to enter the pool water.
  • Children under the age of 14 must be accompanied by an adult while in the pool facility.
  • Hot water immersion while under the influence of alcohol, narcotics, drugs, or medicines may lead to serious consequences and is not recommended.
  • Exceeding 15 minutes of exposure to warm or hot water may result in nausea, dizziness, or fainting – is extremely dangerous – and is not recommended.
  • A person having a communicable disease transmissible by water is excluded from using the pool or spa.
  • A person having any exposed sub-epidermal tissue, including open blisters, cuts, or other lesions may not use the pool.
  • Any child under three years old, any child not toilet trained, and anyone who lacks control of defecation shall wear a water-resistant swim diaper and waterproof swimwear. Swim diapers and waterproof swimwear shall have waist and leg openings fitted such that they are in contact with the waist or leg around the entire circumference.
  • Persons using prescription medications should consult a physician before using the pool or spa.
  • Elderly persons, pregnant women, infants and those with health conditions requiring medical care should consult a physician before using the pool / spa.
  • Proper swim attire required in the pool or spa - no cut-offs. Diapers on children do not constitute appropriate swimwear. Cotton and other fibers from non¬swimwear material clog the pool filter and should not be introduced into the pool or spa.
  • Shower before entering the pool or spa as this will remove suntan oils or lotions. These foreign substances can clog the filter, which can lead to unhealthful water conditions and added expense for chemicals.

  • LPEHOA, Inc. is not responsible for accidents or injuries to you or your guest - Use pool at your own risk -.
  • Swim at Your Own Risk—No Lifeguard on Duty
  • No diving into the pool or spa is allowed.
  • Keep the pool facility gates closed – do not prop open.
  • No running, pushing, or other dangerous horseplay in pool or spa area
  • No smoking (including e-cigarettes) in pool or spa area
  • No glass in pool or spa area
  • No food, drink, or wrappers shall be permitted within 5 feet or in the pool or spa
  • Be considerate of your neighbors – no yelling or other loud noises
  • No Loud Music—Respect Your Neighbors
  • The life-saving equipment must not be used for play; it is for emergency use only.
  • No balloons or other items not specifically designed for pool use in the pool and spa areas.
  • No skateboards, rollerblades, roller-skates, scooters, bicycles, shoes with wheels, tricycles, etc. are not permitted inside the pool facilities.
  • Care for and use pool furniture appropriately – Replace pool furniture in proper locations when use is complete.
  • Clean pool furniture (chairs and tables) upon completion of use – keep it nice for the next user.
  • Clean the BBQ and countertops after use—eliminate pest infestation and prepare for the next user. Cleaning supplies are located under the BBQ area.


Clubhouse Rental and Use Regulations
  • Only LPEHOA, Inc. homeowners (or their resident, renter, or lessee), in good standing will be allowed to rent the clubhouse.
  • Any LPEHOA, Inc. homeowners (or their resident, renter, or lessee) with delinquent Association dues, violation of rules or deliberate abuse of the recreation facilities or common areas will not be allowed to rent the clubhouse.
  • Clubhouse rentals will be on a first-come / first-served basis; however, the clubhouse is not available for rent over the Memorial Day weekend (Saturday through Monday), 4th of July/weekend, Labor Day weekend (Saturday through Monday), Christmas Eve/Day or New Years Eve/Day.  Additionally, LPEHOA, Inc. Board scheduled events at the clubhouse take precedent over rental requests.
  • To allow all LPEHOA, Inc. residents an opportunity to host their event at the clubhouse, there is a limit for rentals of no more than three rentals a month.  
  • Clubhouse renters must be an owner / renter / lessee and at least 18 years of age or older.
  • Clubhouse rental applicant should submit rental request at least 14 days prior to the date desired in order to guarantee usage if the date is available.
  • The cost to rent the club house is $75.00 ($150 beginning Jan 1, 2023) for the 6 hr period and requires a $250 security deposit which will be returned after successful check off list is verified by LPEHOA agent. A returned check fee of $75.00 is applicable if your rental funds returned by the bank.
  • Clubhouse rentals and payments will be coordinated with the LPEHOA Board.
  • LPEHOA, Inc. clubhouse rentals require a completed clubhouse rental form and formal acknowledgement of the club house usage rules.
  • No reservations will be accepted until rental form, security deposits and rental fee have been submitted in their entirety to the Board.
  • Clubhouse rental cancellations must be in writing and turned in to the management company within 7 days prior to event to avoid potential loss of any fees.
  • The responsible parties completing the reservation must be in attendance during the entire length of the rental and understands if he/she leaves the event, the event will end, and the deposit will be forfeited. Owner / renter / lessee MUST be present at all times during the event and have their key fob in possession. Resident or guests will not be allowed in to the pool or rental area without one.
  • There is only one clubhouse rental period daily. Rentals are a first come first served basis. The clubhouse rental period is  for 6 hrs and available from 8 AM to 10 PM daily. The clubhouse must be vacated and cleaned prior to the completion of your rental period. Coordinate your rental period to take into account the time (usually at least 30 minutes) required for clubhouse cleanup. Staying past the rental agreement hours may result in a loss of deposit.
  • Clubhouse renters shall not permit or do anything in the Clubhouse that will disturb, annoy or interfere with the rights, comforts or convenience of LPEHOA, Inc. residents or guests at the pool facility.
  • LPEHOA, Inc. cannot be held responsible for unforeseen mechanical or water chemistry problems associated with heating/cooling, kitchen equipment, BBQ, swimming pool, spa, or electrical failure. LPEHOA, Inc. will make every effort to maintain all equipment and maintain water safety according to Orange County Environmental Pool Regulations.
  • LPEHOA is not liable for accidental injury to persons or loss or damage of group or individual property and applicant renting the club house expressly agrees that they will not hold LPEHOA liable for any of these situations for you or any persons who are on the property.
  • LPEHOA, Inc. does NOT provide cleaning for your event. Please be sure to clean after your event to avoid your security deposit being forfeited.  
  • Cleanup of the areas rented is required by the responsible party. Cleanup includes, removal of all decorations, trash, and debris and cleanup of the pool facility.  All renters are responsible for cleaning and leaving the facility in its original condition at the time of use or rental. If upon arrival, there is an issue with cleanliness of the facility, the responsible party should contact the LPEHOA, Inc. Board to address the issue. A clean off check list will be provided at time of rental.
  • Clubhouse renter is to remind all guests to be completely dry before entering the clubhouse. Clubhouse renter is responsible for ensuring flooring inside the clubhouse remains dry and safe.
  • Rental of the clubhouse does not include any of the pool areas or the entrance courtyard.
  • Clubhouse rental is restricted to the confined area(s) rented as per the rental agreement.
  • Homeowners may have a radio/media player as long as there are no complaints from the neighboring residents and music must be maintained within acceptable levels at all time as determined by the Association staff or authorized representative. Music must be turned off by 10 PM.
  • Clubhouse rental may not be used for any commercial/endorsement purposes whatsoever. Money or fees exchanged for entrance into the activity/function is strictly prohibited.
  • No selling of any items, including food and beverages are authorized during the clubhouse rental.   
  • Any and all damages to the facility will be charged to the responsible party listed on the rental agreement. In addition to the security deposit being forfeited, the responsible party will be responsible for the additional cost of replacement and/or repair determined by the LPEHOA, Inc. Board cost of such damage will be billed to the owner and could result in a lien on the property if not paid within 60 days.
  • Trash generated during the rental period must be disposed of by the clubhouse renter to their personal residence. There is no trash service at the pool to remove trash. Each trash bag left behind will result in a $50 fine per bag.
  • If the police are called for any reason such as a noise complaint or unruly behavior occurring at the clubhouse during the rental period, the owner will face disciplinary action with the LPEHOA, Inc. Board.
  • Moving the pool area furniture and tables during clubhouse rental is acceptable, as long as such furniture and tables remain available for use by pool patrons and the furniture and tables are  put back in the exact position they were found. The owner renting the clubhouse will be responsible for any damage that was caused during the moving of items..
  • No staples, push pins, or other similar devices may be used to attach items to the walls or other surfaces. Any damage will be deducted from security deposit. Blue painter’s tape is acceptable for use and must be removed as part of the renter’s clubhouse cleaning.
  • Aside from small birthday candles and chafing dish sternos, all other candles or flammable devices are not permitted. Candles, incense, open flames, fireworks, sparklers, or anything involving fire or open flame is strictly prohibited in the clubhouse.
  • Smoking is prohibited inside the pool facility and clubhouse - in accordance with California Smoking Law, smoking is prohibited within 20 feet of any public entrance.
  • Setup, cleaning, breakdown, and storage of all LPEHOA, Inc. tables and chairs that are provided in the rental fee for Clubhouse are the responsibility of the renter. If tables and chairs are not cleaned and returned to storage appropriately or are damaged or missing, the clubhouse renter will be charged accordingly for the current replacement cost.
  • Any other setup items, including food, decorations, linens, or additional tables or chairs and any other items for the clubhouse rental period are the responsibility of the resident.
  • The throwing of rice, confetti, and birdseed within the clubhouse or pool area is prohibited.  
  • Tents are prohibited in the clubhouse or pool area.
  • All decorations, displays, food, drinks, etc. must be removed from the facility by the end of the reservation time. Any items left behind will be discarded. Failure to comply with removal of items may result in loss of deposit.
  • Items required for the clubhouse rental may not be dropped off prior to 8 AM  of the day of your scheduled rental time and everything must be picked up immediately following your event.
  • While there are items in the clubhouse, LPEHOA, Inc. does not take responsibility for any damaged, lost or stolen items.
  • No dance floors/bounce houses in the pool facility, clubhouse, or on the grassy area outside the pool area.
  • In accordance with neighborly use of the space and the Orange County Fire Code, the main entrance to the pool must remain clear at all times.
  • You may only store items in the clubhouse space being rented. This does not include the pool area, entrances, or curbside parking. All items are to be removed after the rental period.
  • No animals, petting zoo, rides, trackless trains, or snow is permitted in the pool, pool facility, or clubhouse.
  • The LPEHOA, Inc. Board reserves the right to restrict any party props that may cause damage to Association property.

The Las Palmas Estates Homeowners Association Board may amend or change these rules and regulations without notice as necessary to ensure the ongoing function of the Las Palmas Estates pool and clubhouse for its residents.
